TelaTap Video Avatar Biometric Privacy & Retention Policy
TELATAP VIDEO AVATAR BIOMETRIC PRIVACY & RETENTION POLICY

TelaTap LLC (“TelaTap,” “we,” “us,” or “our”) provides the TelaTap Video Avatar service, which allows customers to create AI-generated videos using submitted photographs, scripts, and other information.
This TelaTap Video Avatar Biometric Privacy & Retention Policy explains how TelaTap collects, uses, processes, stores, shares, retains, and deletes photographs, videos, facial information, biometric information, and related records used in connection with the TelaTap Video Avatar service.
This Policy supplements the TelaTap Privacy Policy and Terms of Service.
1. What This Policy Covers
This Policy applies to photographs, videos, facial information, and related information submitted to or created through the TelaTap Video Avatar service.
An ordinary photograph is not necessarily considered biometric information under applicable law.
However, artificial-intelligence technology used to create a TelaTap Video Avatar may analyze facial characteristics or process information relating to a person’s face.
Depending on the technology used and applicable law, information generated or processed from those facial characteristics may constitute a biometric identifier, biometric information, scan of face geometry, record of face geometry, or similar legally protected information.
When this Policy refers to “biometric information,” it includes biometric identifiers and biometric information to the extent those terms are defined and protected by applicable law.
2. Information We May Store
When you create a TelaTap Video Avatar, TelaTap may store:

the photograph you upload, including the cropped or prepared version used to create your video;

the completed TelaTap Video Avatar;
-
the script or message you submitted or approved;
-
the voice or other generation options you selected;
-
information concerning the generation of your video;
-
your consent, permission, or authorization confirmations; and
-
other information reasonably necessary to provide, secure, and administer the TelaTap Video Avatar service.
If you upload your own video to a TelaTap-hosted webpage, TelaTap may also store that uploaded video and a thumbnail or preview generated from the video.
3. Why We Use Your Photograph and Facial Information
TelaTap and its authorized technology providers may process your photograph and related facial information as reasonably necessary to:

create the TelaTap Video Avatar you requested;

create facial expressions, lip movements, head movements, or other visual elements necessary to produce the video;

provide an included re-do when requested;
-
make your completed video available for viewing or download;
-
allow you to use the same stored photograph for future TelaTap Video Avatars;
-
provide customer support;
-
prevent fraud, misuse, or unauthorized impersonation;
-
investigate complaints regarding unauthorized use of a photograph or likeness;
-
protect TelaTap, its customers, depicted individuals, and service providers; and
-
comply with applicable legal requirements.
TelaTap does not collect biometric information for the purpose of creating a biometric identification database.
4. Permission and Consent
You may use a photograph with the TelaTap Video Avatar service only when the person shown in the photograph has provided the authorization required to create the requested AI-generated video.
Before processing a photograph, TelaTap may require confirmation that:

the person shown in the photograph has agreed to have their photograph, image, and likeness used to create the requested AI-generated video; and
-
the person submitting the photograph has the legal right or authorization necessary to use that photograph.
Where required by applicable law, TelaTap may require a separate electronic consent or release directly from the person shown in the photograph or that person's legally authorized representative.
TelaTap does not treat the fact that a photograph is available on the Internet, social media, a website, or another publicly accessible source as sufficient authorization to create a TelaTap Video Avatar.
5. Facial and Biometric Information
Creating a TelaTap Video Avatar may require artificial-intelligence technology to analyze facial features contained in the submitted photograph.
Depending on the technology used, this processing may involve information that qualifies as biometric information under applicable law.
When applicable, TelaTap will provide notice regarding:
-
the collection or processing of covered biometric information;
-
the purpose for which the information is collected, processed, stored, or used;
-
the expected retention period;
-
applicable sharing or disclosure; and
-
TelaTap's retention and destruction practices.
Where required by law, covered biometric information will not be collected or processed until TelaTap receives the required consent or written electronic release.
6. Third-Party AI Processing
TelaTap uses third-party artificial-intelligence, video-processing, hosting, storage, and technology providers to create and deliver TelaTap Video Avatars.
These providers currently include fal.ai and may include other technology providers involved in operating models or infrastructure used through fal.ai or other services.
When a TelaTap Video Avatar is generated, the submitted photograph, script, voice selection, and other information necessary to create the video may be transmitted to and processed by these providers.
Third-party providers may temporarily or otherwise retain information in accordance with their applicable agreements, technical requirements, privacy practices, and legal obligations.
Third-party retention periods may differ from TelaTap’s own photo and video retention periods.
TelaTap does not authorize third-party service providers to sell customer photographs or covered biometric information or use such information for unrelated commercial purposes.
Where permitted or required under applicable law and applicable provider arrangements, TelaTap may request deletion of personal or biometric information held by a service provider.
TelaTap may update this Policy if additional information about a provider’s processing or retention practices becomes available.
7. We Do Not Sell Biometric Information
TelaTap does not sell, lease, trade, or otherwise profit from a person's biometric identifiers or biometric information.
Payment for a TelaTap Video Avatar is payment for TelaTap’s video-generation service. It is not payment for the sale of a person's biometric information.
TelaTap does not use customer photos, videos, or facial information to train artificial-intelligence systems.
8. Security
TelaTap uses reasonable administrative, technical, and organizational safeguards designed to protect photographs, videos, personal information, and covered biometric information from unauthorized access, disclosure, alteration, loss, or destruction.
Where required by law, covered biometric information is stored, transmitted, and protected using a standard of care that is at least as protective as the manner in which TelaTap protects other confidential or sensitive information.
No electronic storage or transmission method can be guaranteed to be completely secure.
9. How Long We Keep Your Photos and Videos
The following periods apply to photographs and completed videos stored by TelaTap.
Customers With an Active TelaTap Plan
While an applicable TelaTap plan remains active, TelaTap may retain the photographs and videos associated with that account so the customer can access and use them.
When a TelaTap Plan Ends
If the applicable TelaTap plan expires, is canceled, or otherwise becomes inactive, TelaTap may retain associated photos and videos for up to 90 days.
This provides time for the customer to reactivate the plan or download completed videos.
After the 90-day period, the applicable photos and videos may be permanently deleted.
Standalone TelaTap Video Avatars
If a TelaTap Video Avatar was purchased without an applicable TelaTap plan, TelaTap may retain the customer's Video Avatar photographs and completed videos for up to 12 months after the customer's most recent TelaTap Video Avatar.
After that period, the applicable photos and videos may be permanently deleted.
Creating another standalone TelaTap Video Avatar may therefore restart the 12-month storage period for Video Avatar photos and videos associated with that customer.
Customers should download completed videos and maintain their own copies.
10. Biometric Information Retention and Destruction
The photo and video storage periods described above are separate from retention requirements that may apply to covered biometric information.
TelaTap retains covered biometric information, if any, only for as long as reasonably necessary to accomplish the purpose for which it was collected or processed, subject to applicable law.
Illinois
For biometric identifiers or biometric information subject to the Illinois Biometric Information Privacy Act, TelaTap will permanently destroy or cause the permanent destruction of the covered biometric information when the initial purpose for collecting or obtaining it has been satisfied or within three (3) years of the individual's last interaction with TelaTap, whichever occurs first, unless retention is otherwise permitted or required by applicable law or valid legal process.
Texas
Where Texas biometric-retention requirements apply, TelaTap will destroy covered biometric identifiers within a reasonable period after the purpose for collecting the identifier expires and within the maximum period required by applicable Texas law, unless a lawful exception permits or requires longer retention.
TelaTap may take reasonable steps to cause covered biometric information maintained by its processors to be deleted when required by applicable law and available under TelaTap's contractual arrangements with those providers.
11. Before Scheduled Photo or Video Deletion
When reasonably practicable, TelaTap will send an email approximately 30 days before stored Video Avatar photos or videos are scheduled for deletion so the customer has an opportunity to download and retain completed videos.
Customers are responsible for maintaining a current email address with TelaTap.
Customers should download and maintain their own copies of completed TelaTap Video Avatars.
Once TelaTap permanently deletes a photo or video, it may not be recoverable.
12. Requesting Earlier Deletion
You may request deletion of eligible photos or TelaTap Video Avatars stored by TelaTap at any time by emailing:
TelaTap may take reasonable steps to verify your identity or authority to make the request.
After verification, TelaTap will process an eligible deletion request in accordance with applicable law and TelaTap's technical capabilities and will confirm when the request has been processed.
When applicable and required by law, TelaTap may also submit an appropriate deletion request to service providers processing applicable personal or biometric information on TelaTap's behalf.
Certain information may be retained when permitted or required by law, including consent records, transaction records, security records, fraud-prevention information, or records necessary to establish, exercise, or defend legal rights.
13. Removing or Replacing Videos
If a customer removes a video section from a TelaTap webpage or replaces an uploaded video with another video, the previous active video file may be removed from the applicable webpage or active storage at that time.
Removal of a video from TelaTap does not automatically delete copies that have previously been downloaded or distributed outside TelaTap.
14. Consent and Confirmation Records
TelaTap maintains records of permissions, consent confirmations, authorizations, and releases associated with TelaTap Video Avatars.
These records may be retained after the associated photograph or completed video has been deleted.
TelaTap keeps these records as reasonably necessary to:

document that permission or consent was provided;
-
respond to complaints or disputes;
-
demonstrate compliance with applicable requirements;
-
prevent or investigate unauthorized use;
-
respond to lawful requests; and
-
establish, exercise, or defend legal rights.
Consent and confirmation records may include the person's name, date and time of consent, the version of the consent presented, transaction information, and related records reasonably necessary to document authorization.
Consent records are separate from covered biometric identifiers or biometric information.
Retention of a consent record does not authorize TelaTap to retain covered biometric information beyond an applicable legal destruction period.
15. Videos You Have Downloaded or Shared
Deleting a video from TelaTap does not delete copies that have already been downloaded, saved, shared, or published elsewhere.
If you downloaded a video to your phone, computer, cloud-storage account, or another device or service, you are responsible for managing or deleting that copy.
If you published a video on Facebook, Instagram, LinkedIn, YouTube, another website, or another third-party platform, you are responsible for managing or deleting the video through that platform.
TelaTap cannot delete a copy of a video that is no longer stored or controlled by TelaTap.
16. Withdrawal of Consent
Where applicable law provides a right to withdraw consent, you may contact TelaTap at welcome@telatap.com.
Withdrawing consent may prevent TelaTap from completing a pending TelaTap Video Avatar or providing future Video Avatar services using the affected photograph.
Withdrawal of consent does not necessarily require TelaTap to delete records that TelaTap is legally permitted or required to retain.
17. Changes to This Policy
TelaTap may update this Policy to reflect changes in its technology, service providers, retention practices, Services, or applicable law.
The most current version will be posted on TelaTap’s website with an updated revision date.
When required by applicable law, TelaTap will provide appropriate notice of material changes.
