Welcome to TelaTap! The terms "we", "us" and "our" refer to TelaTap. TelaTap operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). TelaTap is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address and billing and payment information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
TelaTap offers digital products only. We have made every effort to provide an accurate representation of our products and services in our online store. However, please note that colors or product appearance may differ from how they appear on your screen due to your device type, settings, and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted in our online store.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. TelaTap reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until TelaTap confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as TelaTap may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address and/or phone number provided at the time the order was made.

You represent and warrant that your purchases are for your own personal or business use and not for unauthorized resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
We may offer promotions from time to time that are governed by separate terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate payment and account information for all purchases. You agree to promptly update your account information, including your email address and payment details, so that we can complete your transactions and contact you as needed.
SECTION 5 - DIGITAL DELIVERY
All TelaTap products are delivered digitally. Upon order confirmation and payment processing, your digital product will be delivered to the email address provided at checkout. Delivery is typically immediate but may vary due to technical factors outside our control.
TelaTap is not responsible for delivery issues resulting from an incorrect email address provided at checkout. Please ensure your contact information is accurate before completing your purchase.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by TelaTap, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal or internal business use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent. All rights not expressly granted herein are reserved by TelaTap.
TelaTap's names, logos, product and service names, designs, and slogans are trademarks of TelaTap or its affiliates or licensors. You must not use such trademarks without the prior written permission of TelaTap.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have control over.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use of optional tools offered through the site is entirely at your own risk and discretion.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party websites you choose to access. If you decide to leave the Services to access third-party sites, you do so at your own risk.
We are not liable for any harm or damages related to your use of any third-party websites, products, or services. Please review third-party policies carefully before engaging in any transaction.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
TelaTap is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with TelaTap. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TelaTap, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TelaTap.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit may be transmitted to and shared with Shopify as well as third parties that may be located in other countries.
SECTION 11 - FEEDBACK
If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use.
You represent and warrant that you own or have all necessary rights to any Feedback you submit and that your Feedback complies with these Terms. We are under no obligation to maintain your Feedback in confidence, pay compensation for it, or respond to it.
You are solely responsible for any Feedback you submit and its accuracy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any errors or inaccuracies and to change or update information at any time without prior notice.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services to: (a) engage in any unlawful or malicious activity; (b) violate any applicable laws or regulations; (c) infringe upon intellectual property rights; (d) harass, harm, or defame any person; (e) transmit false or misleading information; (f) send spam or unsolicited promotional material; or (g) impersonate any other person or entity.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, sell, or exploit any portion of the Services; (c) collect personal information of others; (d) use bots, scrapers, AI agents, or automated tools to access the Services; or (e) interfere with or circumvent the security features of the Services. We reserve the right to suspend or terminate your account at any time for any violation of these Terms.
SECTION 14 - AGENTS
This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of any person or entity without direct supervision.
No Agent may access or interact with the Services unless it: (i) identifies itself in all HTTP/HTTPS requests using the format "Agent/[agent name]" in the user agent string; (ii) does not conceal or mimic human behavior; (iii) responds truthfully when asked if interactions are from a human or computer; and (iv) does not circumvent any measure intended to control Agent access.
We may limit, by technical measures, whether and how any Agent accesses the Services.
SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
Sections covering Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Privacy Policy will survive any termination.
SECTION 16 - DISCLAIMER OF WARRANTIES
The information presented through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.
EXCEPT AS EXPRESSLY STATED BY TELATAP, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL TELATAP, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES.
SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless TelaTap, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
SECTION 19 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity of any other provisions.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms of Service, together with any policies posted on this site, constitute the entire agreement between you and TelaTap and govern your use of the Services, superseding any prior agreements between you and us.
SECTION 21 - ASSIGNMENT
You may not transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
SECTION 22 - GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Mississippi. You and TelaTap consent to venue and personal jurisdiction in the state and federal courts located in Mississippi.
SECTION 23 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. We will notify you of any material changes in accordance with applicable law. Your continued use of the Services following any changes constitutes acceptance of those changes.
SECTION 25 - NOTARY PROFILE HOSTING
TelaTap offers a hosted profile page service for notary publics and other professionals ("Notary Profile Service"). The following additional terms apply to customers who purchase and use the Notary Profile Service.
Hosting Only. TelaTap provides web hosting and page delivery services only. TelaTap is not a notary service, notary referral service, or staffing agency of any kind. TelaTap does not employ, contract with, or represent any notary whose profile is hosted on our platform.
No Verification of Credentials. TelaTap does not verify, authenticate, endorse, or guarantee the accuracy of any information, credentials, certifications, licenses, or qualifications listed on any notary profile page. All profile content is provided solely by the notary and is their sole responsibility. The disclaimer "Profile information is provided by the notary. TelaTap does not verify credentials or certifications listed on this page" displayed on each profile page is incorporated into these Terms by reference.
Notary Responsibility. By purchasing and setting up a Notary Profile, you represent and warrant that all information you provide is accurate, current, and complete, and that you hold any credentials or certifications you list. You agree to promptly update your profile if any information changes or becomes inaccurate.
Client Responsibility. Any person who engages a notary through or after viewing a TelaTap-hosted profile does so at their own risk. TelaTap is not a party to any agreement between a client and a notary, and TelaTap is not responsible for the quality, legality, or outcome of any notarization services performed.
Profile Removal. TelaTap reserves the right to remove or suspend any notary profile at any time if we determine, in our sole discretion, that the profile contains false, misleading, or harmful information, or violates these Terms.
SECTION 27 - AFFILIATE PROGRAM TERMS
Program Overview. TelaTap operates an affiliate program ("Partner Program") that allows approved individuals and organizations to earn commissions by referring customers to telatap.com. By registering as an affiliate, you agree to these terms in addition to all other sections of these Terms of Service.
Approval. TelaTap reserves the right to approve or reject any affiliate application in its sole discretion. Acceptance into the Program is not guaranteed, and you have no legal recourse against TelaTap for a rejected application.
Affiliate Links and Tracking. Upon approval, you will receive a unique tracking link through our affiliate platform. You may promote TelaTap products using your tracking link on online channels such as social media, websites, email newsletters, and offline channels such as events, print materials, and in-person referrals. If a customer clicks multiple affiliate links, the most recent click is credited. TelaTap uses cookies to track referrals; if a customer disables or clears cookies, the referral cannot be tracked and no commission will be paid.
Commissions. Approved affiliates earn the following flat-rate commissions per completed sale:
- Digital Business Card ($9.99/year) — $3.00 per sale
- Notary Web Page ($24.99/year) — $5.00 per sale
- Notary Bundle ($29.99/year) — $6.00 per sale
Commissions apply to the initial purchase and to each annual renewal by the referred customer. Commissions are not earned on sales that result in a refund or chargeback.
Payout Schedule. Commissions are paid on a semi-monthly basis:
- Sales completed the 1st–15th of the month are paid on the 30th
- Sales completed the 16th–31st are paid on the 16th of the following month
A minimum account balance of $10.00 is required before a payout is issued. Affiliates are responsible for providing accurate payment information. TelaTap's primary payout method is PayPal. Alternative arrangements may be made at TelaTap's discretion.
Prohibited Conduct. Affiliates may not: (a) use spam, misleading advertising, or deceptive practices to promote TelaTap; (b) place TelaTap ads on sites containing illegal, harmful, or offensive content; (c) misrepresent TelaTap's products, pricing, or features; (d) self-refer or refer purchases made by themselves or their immediate household; or (e) use TelaTap's trademarks or brand assets without prior written approval.
Removal from Program. Either party may terminate affiliate participation at any time. To request removal from the Program, contact welcome@telatap.com. TelaTap reserves the right to remove any affiliate for violation of these terms, fraudulent activity, or any other reason at its sole discretion. Any unpaid commissions on legitimate, completed sales at the time of termination will be paid on the next scheduled payout date.
Activity Requirement. To maintain an active affiliate account, affiliates must generate at least one (1) referred sale within 60 days of their approval date. Affiliates who have not generated a sale within 45 days will receive a courtesy notification with available promotional resources. Affiliates who have not generated a referred sale by day 60 will be removed from the Partner Program. Former affiliates are welcome to reapply and are subject to review and approval at TelaTap's discretion. Any commissions earned on legitimate, completed sales prior to removal will be paid on the next scheduled payout date.
No Employment Relationship. Affiliates are independent of TelaTap. Nothing in these terms creates an employment, partnership, joint venture, or agency relationship between TelaTap and any affiliate.
